TERMS OF SERVICE
The deal, in plain words.
Take Dictation is software you buy once and run on your own Mac. These terms describe what you get, what we promise, and what we do not.
1. Who you are dealing with
Take Dictation is made and published by Shifted Music LLC (“we”, “us”). In these terms, “the app” means the Take Dictation software for macOS, and “you” means the person or household that installs or buys it.
By installing or using the app you agree to these terms. If you do not agree, do not install or use it.
2. What Take Dictation is
Take Dictation is a downloadable software product. It is not a service, a subscription, or human-delivered work. You buy a licence to run the software; nothing here obliges us to perform any task on your behalf.
The app requires an Apple silicon Mac running macOS 26 or later. Everyday dictation is processed on your Mac and does not require an account.
3. Your licence
When you buy Take Dictation you get a perpetual, non-exclusive licence to use the version you bought, for personal use within one household. “Household” means you and the people who live with you, on the Macs you and they personally use. It does not cover deploying the app across an organisation, a client base, or a customer-facing fleet.
You may not resell, rent, sublicense, or redistribute the app or your licence key. You may not attempt to defeat the licensing mechanism, and you may not remove or alter our notices.
We keep all ownership of the app. Buying a licence does not transfer copyright or any other intellectual property to you.
4. Trial
Take Dictation includes a fully featured 14-day trial. The trial is the same software as the paid app, not a reduced version. No payment details are required to start it, and it does not convert into a charge on its own. When the trial ends you can buy a licence or stop using the app.
5. Price, payment, and who processes it
Take Dictation costs $39 USD as a one-time purchase. There is no recurring charge and no automatic renewal.
Our orders are processed by Paddle.com Market Ltd (“Paddle”), which acts as the merchant of record. Paddle handles payment, invoicing, and any applicable sales tax or VAT, and appears as the seller on your statement and receipt. Questions about the app itself come to us through our support form.
6. Refunds
We offer an unconditional refund within 30 days of purchase. The full policy is on the Refund Policy page and forms part of these terms.
7. Updates
We may release updates that fix problems, improve the app, or adapt it to new versions of macOS. The direct-download app can check a signed update feed so it can tell you when a new version is available. We do not promise any particular update, feature, or release schedule, and a future version may change or remove a feature.
8. Privacy
How we handle information is described on the Privacy Policy page, which forms part of these terms.
9. Acceptable use
Use the app lawfully. You are responsible for what you dictate and for having the right to record and transcribe it, including where the law requires the consent of other people present.
10. No warranty
The app is provided “as is”. Speech recognition is inherently imperfect: it will sometimes mishear you, and cleanup may change wording in ways you did not intend. Always read what the app produces before you rely on it or send it.
To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or accurate in every case. Nothing here excludes any right you have under consumer law that cannot be excluded by agreement.
11. Limitation of liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. The limits below apply only to the extent the law permits them.
Subject to that, and to the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost data, or lost work, arising from your use of or inability to use the app.
Our total liability to you for any claim relating to the app is limited to the amount you actually paid for your licence. Given the 30-day unconditional refund, that amount is straightforward to recover if the app is not right for you.
12. Ending the licence
You can stop using the app at any time by uninstalling it.
We may end your licence if you materially breach these terms. Except where the breach cannot sensibly be put right, we will tell you what the problem is and give you a reasonable opportunity to fix it before we do. If we end your licence within the refund window and you have not breached these terms, we refund you.
13. Governing law and disputes
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California.
If you live somewhere whose consumer-protection law gives you the right to bring a claim locally, or applies protections that cannot be set aside by agreement, this clause does not take that away from you.
14. Severability
If any part of these terms is found unenforceable, that part is limited or removed to the minimum extent necessary and the rest stays in force.
15. Entire agreement
These terms, together with the Refund Policy and Privacy Policy, are the whole agreement between us about the app, and replace any earlier statements about it. If you also agreed to terms with Paddle at checkout, those cover your payment; these cover the software.
16. Changes to these terms
We may update these terms. When we do, we change the “Last updated” date at the top of this page. Changes apply going forward, not retroactively to a purchase you have already made.
